  DIGITAL DEFENSE 101 :

PROTECTING YOUR CLIENT’S ELECTRONIC COMMUNICATIONS and DIGITAL INFORMATION FROM

 COMPROMISE IN ENHANCED RISK SCENARIOS

Synopsis: In the course of acrimonious litigation (matrimonial, custody, or other), determined adversaries, including estranged spouses, have turned to all forms of electronic spying to gain a strategic advantage, and sometimes, simply as a form of cyber / psychological warfare against their adversaries.  With the use of laptops, smartphones, tablets so prolific, and with wireless internet and shared cloud computing environments in virtually every home and office, clients and counsel must take great care to ensure their confidential electronic communications remain private, and that sensitive digital information remains secure from the reach of adverse parties.  This lecture will identify the most common sources through which compromises of this information occurs and present practical, plain English explanations on how to mitigate those risks. It will also discuss the legal and ethical boundaries between aggressive investigation/proper collection of digital evidence/information and unlawful/unethical tactics to obtain such information.
